Waiver
 
The undersigned participant (“Participant”) agrees to indemnify and hold harmless the Cystic Fibrosis Foundation (“CFF”) from all cost, expense, and liability arising out of participation in this shoot (“Event”); hereby waives and releases all claims, which may be caused by any act, or failure to act, by CFF, its officers, agents, or employees, arising directly or indirectly from participation in this Event; and hereby assumes liability for any loss arising from such participation.  Participant acknowledges that Participant (i) has been fully informed of and understands the inherent hazards and risks associated with participating in events of this type; (ii) is qualified, in good health and in proper physical condition; (iii) has the skill and ability to participate in this Event; and (iv) agrees to wear and use all appropriate safety equipment.  

Participants enter an area where photography, audio and video recording may occur. By entering the Event premises or Virtual space or otherwise joining Virtually, the Participant consents to such recording media and its release, publication, exhibition, broadcasting or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites and any other use deemed appropriate by CFF, and Participant waives all rights to any claims in connection with any such recording, release, publication, exhibition, broadcasting, reproduction or use. 

When contemplating Events In-person (Minors aged 16 or 17 only) or Virtual (all ages) involving physical activity and determining whether Minors should participate, parents and guardians should carefully consider whether the nature of the Event contemplated, and the abilities of the Minor present any risks and act accordingly. 

I fully understand, acknowledge, and voluntarily accept the risks in the shooting of firearms (“Activities”). I understand that the Activities are inherently dangerous and that participating in them may result in injuries, death, and economic loss. These injuries or outcomes may arise from my own or other’s actions, inactions, negligence, or the condition of facility. I also understand that neither CFF nor the Facility may eliminate the inherent risks in the Activities. 
 
COVID-19 Waiver
 
I hereby forever release and waive my right to bring suit against CFF and its officers, directors, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to attendance at a CFF event. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease, or property losses, or any other loss, including but not limited to claims of negligence, and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen. 

Assumption of risk: By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending a CFF event. I understand that the risk of becoming exposed to or infected by COVID-19 at a CFF event may result from the actions, omissions, or negligence of myself and others, including, but not limited to, CFF employees, volunteers, and event participants and their families.  


 
Attendance Policy
 
Safety on the day of the event is the CFF’s number one concern. Please help us maintain a safe environment for all registered participants.  
  • Event participants must be registered.  
  • All minors attending this event must have this waiver executed by a parent or legal guardian.  
  • Restrictions may be imposed on the number of event participants allowed on the day of the event. Fees could be assessed against CFF for exceeding the number of event participants, volunteers and staff allowed.  
  • For safety concerns and out of the respect to all registered CFF event participants, we ask that “guests” or unregistered participants NOT be invited to join the event during the course of the event. Additional unregistered participants could compromise safety resources and diminish the experience for registered participants.  


Important Note on Attendance at Foundation Events  

Medical evidence shows that germs may spread among people with cystic fibrosis through direct and indirect contact as well as      through droplets that travel short distances when a person coughs or sneezes. These germs can lead to worsening symptoms and speed decline in lung function. To further help reduce the risk of cross-infection, CFF’s attendance policy recommends inviting only one person with cystic fibrosis to attend the indoor portion of an event at a specific time. For the outdoor portion, CFF recommends that all people with cystic fibrosis maintain a safe 6-foot distance from each other at all times. 

Please note that CFF has the right to ask any Participant to leave an In-person Event or to not participate Virtually at any time if this policy or other CFF policies are not followed. 

I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE.
